Terms of service

This is a working draft. It will be reviewed by an Australian lawyer before we take on paying customers.

What this covers

These terms apply to the platform that builds and runs a branded booking app for your business, together with the web screens you use to manage it. They are between us and the business that subscribes, not between us and that business's clients.

If your clients use the app you publish, their relationship for the service being booked is with you. We provide the software that carries the booking.

Your account

You sign up once, with your email address and a password of your choosing or with a Google account, and that single login is yours rather than any one business's. One account runs one app; if you open a second location later, it needs its own account with us.

The people who work for you are different. Staff and client accounts are created inside a business and use an email address, and they exist only within that business. The same person working at two businesses has two separate accounts, and neither can see the other's data.

  • Keep your login details to yourself. Anyone who has them can see and change everything in your business.
  • Tell us promptly if you think your login has been compromised.
  • We will never ask you for your password, and we will never ask you for the password to an Apple, Google or bank account.

Ordering and setting up

When you order, the price shown at that moment is the price we charge, and we keep a copy of it against your order. If we change our prices later, what you already ordered does not change.

Once your first payment succeeds, your business is created and you can sign in and start setting it up. Preparing and submitting the app to the stores is separate work that we do afterwards.

  • You choose a short web address for your business when you order. It can be changed while we are still setting up, but once your app has been built it is fixed — the copies already installed on people's phones look for that address.
  • Nothing is charged until you complete payment.

Your subscription

A subscription runs month to month, or year to year if you have chosen yearly billing. There is no minimum term and no exit fee.

A setup fee, where one applies, covers the work of setting your app up and getting it live: applying your branding, preparing the store listing, moving your existing data across, handling the review and one training session. It is charged once at the start and is not a purchase of the app.

  • You can cancel at any time, effective at the end of the period you have paid for.
  • Yearly billing is paid up front for the whole year. If you cancel part way through a year, your app keeps running until the year you have paid for ends, and we do not refund the months you did not use. Nothing further is charged after that.
  • Nothing in these terms limits the consumer guarantees you have under the Australian Consumer Law. If we fail to deliver what we promised, those rights still apply, including a refund where the law requires one.
  • If you do not cancel, the subscription renews automatically for another period — another month on monthly billing, another year on yearly billing — at the price then published.
  • If a payment fails, your business keeps running and we email you. If we still cannot take payment after seven days it is paused, and it starts again as soon as a payment succeeds.
  • While a business is paused, its app cannot take bookings. Your data is not deleted, and nothing is lost when it starts again.
  • If you cancel an order before the business is set up, we cancel the subscription with the payment provider at the same time so that nothing further is charged.

What you own, and what we own

Your business name, logo, photos, service descriptions and client records are yours. You can ask for an export of your client and booking data at any time, including when you leave.

The app is published through our Apple and Google developer accounts, so the store listings are held by us. The branding on them is yours. If you would prefer to hold the listing in your own name, we can transfer it to your own developer accounts for a fee.

The platform itself — the source code, the design of the shared system and the servers it runs on — remains ours. Subscribing gives you the right to use it, not a copy of it.

The app stores

Apple and Google decide whether an app is published and how long a review takes. We prepare and submit builds and respond to reviewer questions, but we cannot promise a date or an outcome.

We hold the developer accounts and pay Apple's and Google's fees, so there is nothing for you to set up or pay for on their side.

If your subscription ends, we remove the app from the stores. Clients who already installed it will see a notice rather than a broken app.

Payments taken from your clients

Where card payments are switched on, money from your clients goes directly to your own account through the payment provider. We never hold your takings and we do not take a percentage of them.

The payment provider charges its own processing fee, in the same way a card terminal does. Refunds are yours to issue, from the same screens.

A refund is a request to the payment provider rather than something that happens instantly. It usually reaches your client's account within a few days, and on the rare occasion one fails we correct the record so your books stay right.

Invoices, GST and tax

Where invoicing is switched on, you enter your own ABN and tell us whether you are registered for GST. We put those on the invoices exactly as you gave them to us.

Deciding whether to register for GST, what to charge and what to report is yours. We are not accountants and nothing in the platform is tax advice. If you are not registered for GST, do not switch GST on — charging it without being registered is against the law.

Invoice numbers run in order. Once an invoice has been sent, its number is fixed and never used again: you cannot edit it, only void it, and the voided invoice stays on the books rather than disappearing. Drafts you delete before sending are a different matter — they were never issued, and deleting one can leave a gap in the sequence.

Availability

We aim to keep the service running at all times, and we will give notice before any planned maintenance that would interrupt bookings. We cannot promise uninterrupted service, and we are not able to control outages at the app stores, the payment provider or the networks in between.

Acceptable use

  • Do not use the platform to send messages people have not asked for, in breach of the Spam Act 2003.
  • Do not upload content you do not have the rights to, or content that is unlawful.
  • Do not attempt to reach another business's data, or to work around the limits of the plan you are on.
  • Keep your own logins secure, and tell us promptly if you think one has been compromised.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law, which cannot be excluded.

Beyond those rights, our liability in connection with the service is limited to resupplying the service or refunding what you paid for it in the twelve months before the claim, whichever we choose.

Ending the agreement

You can cancel at any time. Cancelling stops the next renewal; it does not end the period you have already paid for. We may end an agreement if fees remain unpaid after we have told you, or if the platform is being used in a way that breaks the acceptable use section above.

On request within ninety days of ending, we will provide an export of your client and booking data in a common format.

Changes to these terms

If we change these terms in a way that affects you, we will tell you by email at least thirty days beforehand. Continuing to use the service after that date means the new terms apply.
